Health Information Portability and Accountability Act (HIPAA)
|
|
In December, the U.S. Department of Health and Human Services released new privacy standards prohibiting the release of individually identifiable health information. The standards, part of the Health Insurance Portability and Accountability Act of 1996 (HIPAA), specifically include schools, colleges and universities. Under the new rules anyone who allows confidential health information to become public whether intentionally or unintentionally can be fined. As well, parents have the right to review their child’s medical information and require correction of erroneous data.
Parents and educators concerned about the impact of new HIPAA standards should ask:
- Who dispenses health care and medications at my school?
- How are student medical records transmitted, stored and accessed?
- What safeguards does the school offer parents, who have the right to check their child’s record for accuracy?
Why is purchasing Sapphire SchoolNurse so important to a HIPAA Compliance Strategy?
- Each time a medical record is changed, a liability risk is incurred based on the changes. It is imperative that the software chosen for automation contain an “audit log” to irrevocably track all changes to the medical record. This “audit log” must then become part of the permanent record and be attached to the record if the student transfers schools. Employing this procedure protects the District in the event that a change or reasons for a change are brought into question. Sapphire SchoolNurse is the only software package that has the audit log as part of the permanent record.
- Encryption technology to protect school district data during transmission process.
- Use of multi-level user authorization system to limit access to system functions.
- Password protection features that require users to modify their passwords at periodic intervals.
HIPAA’s new regulations are a significant change for the standard operating procedures of schools. Sapphire SchoolNurse can greatly reduce the burden of compliance while allowing for better care of the students in a school districts charge. It is the only software package specific to the school health market that can truly claim it addresses each of the issues involved in HIPAA’s standards.

Family Education Rights and Privacy Act (FERPA) of 1974
|
|
FERPA affords parents the right to have access to their children's educational records, the right to seek to have the record amended, and the right to have some control over the disclosure of information from the record. When a student turns eighteen years old or enters college, the rights under FERPA transfer to the student.
FERPA defines an educational record as a record that contains information directly related to a student and maintained by an educational agency or institution or by a party acting for such institution or agency. The following are several examples of the types of educational records covered under FERPA: health unit records, and special education records.
In order for a health related software package to assist a school district in adhering to its FERPA regulations, the product must be able to protect the confidentiality of medical records, allow for the release of those records, and allow restricted access to the records.
Sapphire SchoolNurse is the perfect solution for FERPA compliance. It contains the most robust audit trail and security in the industry. All access to the system is password restricted. In addition, sensitive records (AIDS, abuse, pregnancy, etc.) have a second restrictive access filter. Even more important is that an audit trail is created with each viewing or changing of a record. Districts can prevent unauthorized viewing of a record as well as see who was in a record, what it was changed to, who changed it, and when it was changed. To complete the FERPA compliance review, the system allows for reporting of all health encounters and the ability to change records if needed (With the audit trail described above being created). Given this functionality, the system meets all three requirements of FERPA: confidentiality, release, and access.
